This is one of the only pools in Brewster County. The Terlingua Ranch Headquarters also has a restaurant, The Bad Rabbit Cafe, free WiFi, laundry facilities, and water sales. 2- This is a public auction and is conducted by a licensed auction company. There will be a 25% buyer's premium added to the high bid amount of each item won. Buyer's premium added to all invoices, unless otherwise stated in the catalog. The auctioneer will open bidding at a reasonable price or the pre-bid amount on each lot, and may set bidding increments as he/she deems necessary. The auctioneer's decisions are final. No lots will be broken, please do not ask.
3- Lots will be sold to the highest bidder. Absentee bids will be treated as limits, if applicable. GWS Auctions, Inc. reserves the right to refuse any bid and service to anyone for any reason. We reserve the right to pull any items at anytime from our auction. We reserve the right to retract bids as we feel fit.
4- Wording, which is subjective, and other adjectival descriptions are the opinion of the Auction House. No warranty is expressed, implied or provided, since these opinions can and do vary among individuals all bidders bid based on their own opinions of value. No lots may be returned by bidders.
4a- All "Estimated Values" provided are based on retail prices on comparable items in our local market (Los Angeles, CA).
5- All Sales Are Final.
6- All sales are strictly in U.S. dollars. Anyone wishing to purchase lots in CA will also be charged sales tax of 9.75%. All winning bidders pay postage and handling, shipping insurance and delivery confirmation fee.
7-Please call us to make a payment after the auction over, once you receive your invoice. You may also pay it online once we email your invoice through our secure payment system. Due to increased fraud, wire transfer will be required on all purchases over $1500.00. We also accept Venmo or Zelle as forms of payment if you would like expedited shipping.
8- All payments are to be made in full as soon as the hammer falls. NO EXCEPTIONS. If we have not received payment in 48 hours of the auction, a 35% reselling fee will be charged.
9- Postage charges will be based on FEDEX and USPS rates, a handling fee of $1 per item and any costs for packing material (we are honest, and simply charge for boxes and packing material not for packing time and other ridiculous things of that sort). WE SHIP ITEMS IN ACCORDANCE WITH USPS or FEDEX PROCEDURE, SO IN THE EVENT YOU HAVE TO MAKE A CLAIM FOR A DAMAGED ITEM-THE CLAIM WILL NOT BE DENIED. Items will be shipped and insured with delivery/signature confirmation at buyer's expense. IF YOU HAVE TO MAKE A SHIPPING CLAIM, YOU MUST KEEP ALL SHIPPING MATERIALS OR YOUR CLAIM WILL BE DENIED.

10- Bids on behalf of corporations must be personally guaranteed by one or more of it's officers. Any credit card payment made by a corporation is subject to a 4.25% charge. Each bidder is responsible for his/her bids, and cannot act for a third party.
11-The buyer is responsible for attorney, other judicial fees, and expenses involved in collection of outstanding invoices.
11A - Bidder further agrees, regardless of the auction's location, to indemnify and hold Auctioneer harmless from any claim, loss or damage as a result of the auction sale and to bear the risk of any loss or damage to any property included in said auction.
11B- Bidder and Auctioneer agree to mediate any dispute or claim they may
have concerning the enforcement of this agreement. The mediation shall be held in Los Angeles, California or any other location agreed upon in writing by the parties to the mediation with the mediator selected by agreement of the parties. If the parties cannot agree upon a mediator, each party shall select an independent mediator and those mediators shall select a mediator of the
dispute. Should any party fail to mediate their dispute prior to turning to litigation, that party shall lose its right to attorneys' fees as stated below even if determined to be the prevailing party.
11C- Bidder and Auctioneer agree that the exclusive course of action in
any dispute or litigation concerning the enforcement of this agreement shall be held in a Los Angeles County Branch Superior Court, State of California applying applicable California law.
11D - In the event of any dispute concerning the enforcement of this
agreement, including an action for declaratory relief, the prevailing party in that dispute shall be entitled to their reasonable attorneys' fees in addition to any other relief to which that party may be entitled.
11E - The Bidder and Auctioneer agree that this agreement shall be binding on
their heirs, personal representatives, successors and/or assigns, and that any changes to this agreement shall not be enforceable unless in writing and signed by both Bidder and Auctioneer.
12- If you are the winning bidder, you must pay for the item, no exceptions. If you need immediate assistance please call our auction house at: 760-610-4175, if you wait until the auction is over to report a problem with a bid that resulted in a win, and do not pay, you will be charged a 35% reselling fee, subject to the 25% buyer's premium. NO EXCEPTIONS.
13- Please note: Bidding in this auction, whether in person or on the internet, constitutes full acceptance by the bidder of the foregoing terms of sale.
14- All items will be sent within 2-3 (BUSINESS) days of the auction.
15- All terms and conditions are strictly enforced, with no exceptions. We have a "you win, you buy" policy. Please be advised that there is a 25% BUYER'S premium.
16-By accepting these terms and conditions, and bidding in our auction, you automatically agree to our "NO CHARGE-BACK" Policy. Which states-That all bidders agree to NEVER initiate a charge-back for any reason unless we have misrepresented an item, and in that case we ask you to please contact our auction house to give us an opportunity to right the situation prior to you doing a charge-back. 760-610-4175.

Shipping insurance and signature confirmation is required on each package at buyer's expense.
All items will be shipped within 4-6 (BUSINESS) days of the auction, ONLY IF YOU HAVE PAID YOUR INVOICE WITHIN 48 HOURS. IF YOU MAKE A LATE PAYMENT YOUR SHIPPING WILL BE DELAYED UNTIL THE NEXT AUCTION.
In the event that you need to make a claim with FedEx you will need to complete the following:
1) KEEP THE BOX, ALL PACKING MATERIAL & THE DAMAGED ITEM (INCLUDING ALL BROKEN OR DAMAGED PIECES).**IF YOU THROW AWAY THE BOX AND PACKAGING FEDEX WILL DENY YOUR CLAIM.
